Not really looking for a how to guide. But lets say I take my gf son and she allows me to go see a movie in another state. Is that it? What if I had a gun and cross state lines? Is that like two charges of trafficing?
If it’s already a crime and you involved a minor in the crime while crossing state lines, you now trafficked that minor and additional charges are added. Add a gun, more charges.
One crime at a time is the rule for a lot of good reasons. Of course zero crimes is preferable, if we are being picky.
Generally speaking trafficking is bringing something into a place where it is not allowed to be
So in your first example, you are allowed to watch that kid, and both of you are allowed to be in that state and to see a movie, so no, you are not trafficking
Similarly if you are allowed to have that gun in both states then you are not trafficking. Additionally in the US if a case involves crimes across states it’s typically a federal charge and not multiple state ones
People can be trafficked against their will for slavery purposes or by their will as a form of illegal immigration. You can even “traffic” legal goods like cigarettes if you transport them without paying all applicable taxes. It’s a catch-all term for transporting things that a place does not want to let in. Typically the term is only used for bulk transportation, smaller amounts tend to have other more specific crimes
One of the ways Trafficking is defined as
The exploitative movement of people across borders. So taking a kid across a border ro see a film likely isn’t it.
Taking a kid across a state border against the mums wish may be trafficking but will likely just be kidnapping.Taking them across a state border to give to someone is likely going to be trafficking territory.
Intent is the most important factor and why there is a judge in the first place. They judge intent and how it interfaces with the law and case law.
